Lekki's title history is layered: original Eti-Osa community land, Lagos State acquisition, government scheme allocations, and subsequent private transfers. Knowing what document you are buying under is the single most important factor in any Lekki land transaction.
Issued by the Lagos State Governor, a C of O gives 99-year leasehold statutory right of occupancy. It is the gold standard for land ownership in Lagos. In Lekki (Eti-Osa LGA), land was historically under the Eti-Osa Kingdom before state allocation — a properly issued C of O extinguishes all competing customary claims. Always verify the C of O directly against the Lagos Land Bureau records, not only via the document presented by the vendor.
When land with a C of O is sold, the buyer must obtain Governor's Consent under the Land Use Act 1978 to legally perfect the transfer. Without it, the buyer's title is not fully protected. Many Lekki transactions remain unperfected — which is a risk. Perfecting consent costs approximately 3–5% of land value. Include this in your acquisition budget from day one.
A deed of assignment transfers a vendor's interest to a buyer. The deed's security depends entirely on the root title in the chain. A deed tracing back to a registered C of O (with all intermediate consents) is relatively secure. A deed tracing back only to a family layout or community allocation is less so — and common in some Ajah and mid-Lekki sections. Verify the full title chain back to the root deed.
Allocation letters from families (e.g., Jakande, Elegushi, Amuwo royal families) or community associations are not formal statutory titles. They offer informal access to land but are routinely disputed and can be challenged or revoked. Never purchase in Lekki on an allocation letter alone without formal title conversion and C of O filing in progress.

Request the original C of O, deed of assignment, or survey plan (not photocopies). If a vendor cannot produce original title documentation, walk away. For Lekki land, also ask for the Governor's Consent on all intermediate transactions since the original C of O issue date.
Commission an independent registered surveyor (NIESV member) to produce a survey plan confirming the plot boundaries, beacon numbers, and size. The surveyor should confirm the land falls within a charted area on the Lagos Lands Bureau office map. This typically costs ₦50k–₦200k and takes 1–3 weeks. Do not skip this step even if the vendor presents their own survey.
Submit the file number from the C of O and the survey plan to the Lagos State Lands Bureau (Ministry of Physical Planning, Alausa, Ikeja) for an official records search. The search confirms: (a) who the last registered owner is, (b) whether the land has been committed to any mortgage or charge, (c) whether a Governor's Consent has been issued for all transactions. This is non-negotiable for any Lekki acquisition.
Lagos maintains a computerised Land Use Register. Request a printout of the register entry for the file number. Discrepancies between the presented document and the Land Use Register entry are a serious red flag indicating potential forgery or double-dealing.
Lekki (Eti-Osa LGA) sits on a narrow sand barrier between the Lagos Lagoon and the Atlantic Ocean. Many areas are below sea level or on reclaimed land. Before buying, request a digital terrain model or Lagos State Physical Planning Authority (LASPPPA) flood map for the specific plot. Zones near the lagoon shoreline, tidal creeks, and low-lying areas of Ajah and Orchid Road can experience serious flooding in rainy season.
If the vendor does not have Governor's Consent already perfected, budget 3–5% of land value for consent stamp duty, registration fees, and legal fees to perfect the transfer in your name. This cost is normally borne by the buyer. Do not agree to complete the purchase without either the consent already perfected or a written escrow arrangement holding purchase funds until perfection is complete.
