Usual notice lengths, explained in words
These are general starting points for discussion with your lawyer. They are usual periods, not a nationwide rule for every tenancy. The law that applies to the premises and the tenancy agreement must be checked.
- Yearly tenancy: the usual notice is six months.
- Half-yearly tenancy: the usual notice is three months.
- Quarterly tenancy: the usual notice is three months.
- Monthly tenancy: the usual notice is one month.
- Weekly tenancy: the usual notice is one week.
Section thirteen of the Lagos State Tenancy Law 2011, published by the Lagos Ministry of Justice sets out notice periods for the tenancies it covers, including yearly, half-yearly, quarterly and monthly tenancies, and a week for a tenancy at will. A tenancy at will is a distinct category; do not assume it is the same as every weekly tenancy.
Section eight of the Recovery of Premises Act, reproduced in this FCT High Court judgment, also addresses usual notice periods, including weekly tenancies. It should not be treated as the tenancy law for every state. Have a lawyer identify the law and rules that apply to your premises.
The date you are asking for is not a legal calculation
The date in the form is the date you want possession returned. Choosing it does not establish that the notice is long enough or ends correctly. A fixed term that has expired, a periodic tenancy and a tenancy at will can require different treatment. The agreement, applicable law and facts also affect service and recovery.
Read the notice to quit guide and take the draft, tenancy agreement and payment record to a lawyer before serving anything.
The separate seven days' notice step
After a tenancy has been lawfully determined, and once any required notice to quit has expired, the separate notice of owner's intention to recover possession may be needed before court proceedings. Its usual length is seven days. Under the Lagos law, section sixteen addresses this notice, section eighteen its service, and section twenty-four the institution of court proceedings. The required notice, sequence, timing and method of service need a lawyer's advice for the case.
This tool drafts the notice to quit only. It does not draft that separate notice or complete the recovery process. Neither notice gives a landlord permission to remove a tenant by force, change locks, take belongings or disconnect utilities. Our lawful tenant eviction guide explains the broader process, and tenant rights in Nigeria sets out protections both parties should understand.

Frequently asked questions
Does this tool calculate a legally valid quit notice date?
No. You enter the date you are asking for. The tool does not calculate notice expiry or decide whether the date or method of service is lawful. Speak to a lawyer before serving a notice.
What is the usual notice for a yearly tenant?
For a yearly tenancy, the usual notice is six months. The agreement, state law and circumstances matter. Laws differ by state; check your state’s tenancy law and speak to a lawyer before you serve a notice.
Is a notice to quit the same as the seven days’ notice?
No. A notice to quit and the separate seven days’ notice of owner’s intention to recover possession are different steps. A lawyer should confirm which notices are needed, their order and service. Neither notice permits self-help eviction.
Can I change the locks after the date I entered?
No. A date entered in a template does not authorise eviction. Do not change locks, remove belongings, disconnect services or use force. Use the lawful recovery process and obtain legal advice.
Does Cabans keep the details entered here?
No. The form entries stay in this browser and are not uploaded to Cabans or saved by the tool. You can print, save as PDF through your browser or copy the draft for legal review.
